On Eric Bruenner’s latest column, Bee Fisch commented, “If you are not fired by Saturday, then I will start picketing…”
Well, Bee, it’s time to start picketing.
As opinion editor, I rarely post blog entries to defend my columnists against prickly comments. But I took issue with this one because it makes significant allegations based on an incorrect reading of the column.
Bee says,
I am curious to hear your thoughts on the firing of Don Imus, due to how he referred to the Rutgers women’s basketball team. It is very similar to the “pimply-faced date rapists with popped-collars” and the “racist misogynists” that you speak of in your article. Imus was fired, I don’t see why you should receive any punishment other than that.
How similar is it? Did Eric Bruenner call the Duke lacrosse team “pimply-faced date rapists with popped-collars”? Does that description identify only whites?
Bruenner wrote,
Lacrosse, popularly pronounced “lax” by pimply-faced date rapists with popped-collars, is one of my favorite sports.
Nowhere did he say the Duke lacrosse team is composed of “pimply-faced date rapists with popped-collars.” He made a joke about lacrosse. And that description is hardly racist in content.
Bee also said,
Anyone is allowed to think and say what they want. For example, all the stupid things the lax players may have said (I don’t know how trustworthy your sources are) and all of the stupid things you wrote, are all fair game.
Bruenner didn’t argue that anyone should be jailed for racist speech. He only lamented that the media has made heroes out of people who he suspects may be racists. And that assertion, Bee, is fair game.

Your columnist, Eric Bruenner, may or may not be a racist (I suspect he is just an immature, nasty punk)
But he did commit libel, by intentionally repeating what is certainly a false slanderous comment (the Bermuda thing) with specific intent to harm and defame.
If Ryan McFadyen wanted to sue your newspaper (and NYU), it would be a slam dunk.
Time for a discussion with your Dean and your faculty advisor.
Defamation is a big deal, Devlin.
I don’t think discussing anything with a dean would get you very far, since NYU does not dictate the content of our paper or our blogs.
But by all means, go for it.

Really? Because Ryan McFadyen is not mentioned in the article. Bruenner’s assertion is that a girl described meeting a Duke player in the Bahamas who boasted that he sent a death threat to the stripper. Neither Bruenner nor the girl in his class claimed that the Duke player actually did send such an email, only that he boasted of doing so. Only commenters on the article have mentioned the name McFadyen.
Regardless, your interpretation of U.S. libel law is incorrect. And as my colleague stated, go ahead and talk with my dean. NYU does not control the content of WSN.
